About Our Business and the SMS Promotions Program

Kwikclick LLC operates an SMS Promotions Program (the “Program”) that sends promotional, sweepstakes, and giveaway-related text messages to consumers who have opted in to receive them. The Program features participating merchants (“Participating Merchants”) who partner with Kwikclick to offer promotions, sweepstakes entries, exclusive discount codes, and related offers to their customers.

Participating Merchants are independent third-party businesses. Kwikclick LLC is the sole sender of all SMS messages sent through the Program and is responsible for the content of those messages. When you opt in to receive SMS messages in connection with a Participating Merchant, you are opting in to receive messages from Kwik.com (operated by Kwikclick LLC) on behalf of that Participating Merchant.

1. What Information Do We Collect?

Personal Information You Disclose to Us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, opt in to our SMS Promotions Program, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

The personal information we collect may include the following:

  • Names
  • Mobile phone numbers (collected in connection with the SMS Promotions Program)
  • Email addresses
  • Usernames
  • Passwords
  • Contact preferences
  • Contact or authentication data
  • SMS opt-in records (date, time, method of opt-in, and the Participating Merchant in connection with which you opted in)
  • Sweepstakes and promotion participation information (entries, referrals, and information you submit to enter promotions)

We do not process sensitive information.

Application Data

If you use our application(s), we may also collect the following information if you choose to provide us with access or permission:

Push Notifications. We may request to send you push notifications regarding your account or certain features of the application(s). If you wish to opt out from receiving these types of communications, you may turn them off in your device’s settings.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information Automatically Collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information.

Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files.

SMS Delivery Data. In connection with the SMS Promotions Program, we collect message delivery and engagement information, such as whether a message was delivered, opened, or clicked, and the mobile carrier associated with your phone number.

Information Collected from Other Sources

In Short: We may collect limited data from public databases, marketing partners, Participating Merchants, and other outside sources.

In order to enhance our ability to provide relevant marketing, offers, and services to you and update our records, we may obtain information about you from other sources, such as public databases, joint marketing partners, affiliate programs, data providers, Participating Merchants, and other third parties.

When you opt in to the SMS Promotions Program through a Participating Merchant’s website (see Section 5 below), the Participating Merchant transmits your opt-in information (including your mobile phone number, the date and time of opt-in, and the consent disclosure you agreed to) to us so that we can send you the messages you requested.

2. How Do We Process Your Information?

In Short: We process your information to provide, improve, and administer our Services (including the SMS Promotions Program), communicate with you, for security and fraud prevention, and to comply with law.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts.
  • To operate the SMS Promotions Program. We process mobile phone numbers and opt-in data to send you the SMS messages you have opted in to receive, including promotional offers, sweepstakes and giveaway entry opportunities, exclusive discount codes, and customer service messages on behalf of Participating Merchants.
  • To maintain records of consent and opt-out as required by law, including under the Telephone Consumer Protection Act (TCPA) and CTIA guidelines.
  • To protect our Services. We may process your information as part of our efforts to keep our Services safe and secure, including fraud monitoring and prevention.
  • To save or protect an individual’s vital interest, such as to prevent harm.
  • To verify your rewards. We ensure that you have all your accurate rewards and information from the brands you shop from.
  • To respond to customer service inquiries and provide support.

To comply with applicable laws and legal obligations.

3. What Legal Bases Do We Rely On to Process Your Information?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason to do so under applicable law.

The GDPR and UK GDPR require us to explain the valid legal bases we rely on. We may rely on the following:

  • We may process your information if you have given us permission to use your personal information for a specific purpose, including consent to receive SMS messages. You can withdraw your consent at any time.
  • Legitimate Interests. We may process your information when reasonably necessary to achieve our legitimate business interests and those interests do not outweigh your interests and fundamental rights.
  • Legal Obligations. We may process your information where necessary for compliance with our legal obligations.
  • Vital Interests. We may process your information where necessary to protect vital interests.

We may process your information if you have given us express or implied consent. In some exceptional cases, we may process your information without your consent as permitted by applicable law, including for investigations, fraud detection, business transactions, insurance claims, identifying injured persons, addressing financial abuse, complying with subpoenas or court orders, or where information is publicly available.

Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work.

The categories of third parties we may share personal information with include:

  • SMS platform providers and telecommunications carriers that deliver our messages
  • Cloud computing and hosting providers
  • Data analytics providers
  • Payment processors
  • Customer support and communication providers
  • Marketing and advertising providers
  • Performance monitoring and security providers

We also may need to share your personal information in the following situations:

Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition.

Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Notice. Mobile phone numbers and SMS consent data are not shared with affiliates for marketing or promotional purposes.

Business Partners and Participating Merchants. We may share your information with our business partners and Participating Merchants to fulfill sweepstakes prizes or honor discount codes you have redeemed. Mobile phone numbers and SMS consent data are not shared with business partners or Participating Merchants for their own marketing or promotional purposes.

5. SMS/Text Messaging Program

In Short: This section describes how we handle information related to our SMS Promotions Program. No mobile information is shared with third parties or affiliates for marketing or promotional purposes.

This section supplements the rest of this Privacy Notice with respect to SMS messaging.

Program Description

Kwikclick LLC, operating as Kwik.com, operates an SMS Promotions Program that sends promotional, sweepstakes, and giveaway-related text messages to consumers who have opted in to receive them. The Program features Participating Merchants who partner with Kwikclick to offer promotions to their customers. Kwikclick LLC is the sole sender of all messages sent through the Program.

How You Opt In

You may opt in to receive SMS messages from Kwik.com in connection with a Participating Merchant by submitting your mobile phone number through an electronic opt-in form on a Participating Merchant’s website (such as a pop-up form offering sweepstakes entries) and affirmatively checking two separate, unchecked-by-default checkboxes: (1) an SMS consent checkbox that discloses Kwik.com (operated by Kwikclick LLC) as the sender, the types of messages you will receive, the expected message frequency, that message and data rates may apply, and that you can reply STOP to cancel or HELP for help; and (2) a separate acknowledgment that you have read and agree to Kwik.com’s Terms of Service and Privacy Policy and to the Participating Merchant’s Terms and Privacy Policy.

Your consent to receive SMS messages is not a condition of any purchase or of entry into any sweepstakes. A free alternative method of entry (AMOE) is provided for each sweepstakes so that entry does not require SMS opt-in.

Information We Collect Through the SMS Program

In connection with the SMS Promotions Program, we collect:

  • Your mobile phone number;
  • The date, time, IP address, user agent, and the Participating Merchant website on which you opted in;
  • The content of messages you send to us and that we send to you;
  • Delivery and engagement information (such as whether a message was delivered or whether you replied or clicked a link); and
  • Your mobile carrier (as provided by our SMS service provider).

Types of Messages

Messages may include promotional offers, exclusive discount codes, sweepstakes and giveaway entry opportunities, links to participate in promotions, customer service responses, and other communications related to the Participating Merchant whose promotion you opted in to.

Message Frequency

Message frequency varies based on your interactions with the Program and the Participating Merchant. You may receive recurring messages.

Message and Data Rates

Message and data rates may apply. Kwik.com does not charge for SMS messages, but your mobile carrier may charge for sending or receiving text messages based on your plan.

Opt-Out and Help

You may opt out of receiving SMS messages from Kwik.com at any time by replying STOP to any message you receive from us. After you send STOP, we will send a single confirmation message and will not send you any additional SMS messages unless you opt back in. To opt back in, reply START or sign up again through the opt-in method described above. For help, reply HELP to any message or contact us at hello@kwik.com.

No Sharing of Mobile Information with Third Parties

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of personal information described elsewhere in this Privacy Notice exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties or affiliates for marketing or promotional purposes.

Mobile phone numbers and SMS opt-in data are only disclosed to subprocessors that directly support delivery of our SMS Promotions Program (for example, our SMS platform provider and the underlying telecommunications carriers), and only to the extent necessary to send you the messages you have requested. These subprocessors are contractually prohibited from using your mobile information for their own marketing purposes.

Mobile phone numbers and SMS consent data are not shared with Participating Merchants for the Participating Merchant’s own marketing or promotional purposes.

Supported Carriers

Our SMS Promotions Program is available on most major U.S. wireless carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Cricket, and others. Carriers are not liable for delayed or undelivered messages.

Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) and the account holder or authorized user of the mobile phone number you provide. By opting in, you represent and warrant that you meet these requirements.

6. Do We Use Cookies and Other Tracking Technologies?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising.

To the extent these online tracking technologies are deemed to be a “sale” / “sharing” under applicable US state laws, you can opt out by submitting a request as described in Section 13.

Google Analytics

We may share your information with Google Analytics to track and analyze the use of the Services. To opt out of being tracked by Google Analytics across the Services, visit https://tools.google.com/dlpage/gaoptout.

7. Is Your Information Transferred Internationally?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United States. If you are accessing our Services from outside the United States, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information in the United States and other countries.

If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, we will take all necessary measures to protect your personal information in accordance with this Privacy Notice and applicable law, including by using the European Commission’s Standard Contractual Clauses. Our Standard Contractual Clauses can be provided upon request.

8. How Long Do We Keep Your Information?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law.

We retain SMS opt-in records, message logs, and related data for as long as necessary to operate the SMS Promotions Program, comply with our legal obligations (including TCPA recordkeeping requirements, typically a minimum of four years), resolve disputes, and enforce our agreements.

9. How Do We Keep Your Information Safe?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure.

10. Do We Collect Information from Minors?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 11. What Are Your Privacy Rights?

In Short: Depending on your state of residence in the US or in some regions such as the EEA, UK, Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information.

In some regions you have certain rights under applicable data protection laws. These may include the right to request access, rectification, erasure, restriction of processing, data portability, and to not be subject to automated decision-making. If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State or UK data protection authority.

Withdrawing Your Consent

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time by contacting us at hello@kwik.com or by updating your preferences. This will not affect the lawfulness of the processing before its withdrawal.

Opting Out of Marketing and Promotional Communications

You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails we send, replying “STOP” to the SMS messages that we send, or by contacting us at hello@kwik.com.

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can contact us using the contact information provided. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases.

12. Controls for Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

13. Do United States Residents Have Specific Privacy Rights?

In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, or Virginia, you may have rights described below.

Mobile phone numbers and SMS consent data are subject to the additional restrictions described in Section 5 and are not sold or shared with third parties or affiliates for marketing or promotional purposes.

Your Rights

You have rights under certain US state data protection laws, including:

  • Right to know whether or not we are processing your personal data
  • Right to access your personal data
  • Right to correct inaccuracies in your personal data
  • Right to request the deletion of your personal data
  • Right to obtain a copy of the personal data you previously shared with us

  • Right to opt out of the processing of your personal data for targeted advertising, sale, or profiling

California “Shine the Light” Law

California Civil Code Section 1798.83 permits our California users to request certain information about our disclosures to third parties for direct marketing purposes. Submit requests to hello@kwik.com.
